Terms & Conditions

Effective date: June 21, 2026 These Terms & Conditions ("Terms") govern your access to and use of the websites, applications, and production tools, including our call-sheet application ("Services"), provided by Philamedia Co ("Philamedia," "we," "us," "our"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Services.

2. The Services

Philamedia provides production-management tools that let productions create and share call sheets and send scheduling notifications to cast and crew. We may add, change, or remove features at any time.

3. Accounts and access

Some features require an account or an access link. You are responsible for keeping your credentials and personal access links confidential and for all activity under your account or link. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to:

  • use the Services unlawfully or to send unlawful, harassing, or infringing content;

  • upload information about others without authorization to do so;

  • attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Services;

  • use the Services to send unsolicited marketing or spam.

5. Messaging Program Terms (SMS)

Program name: Philamedia Call Sheet Notifications.

Description: When you provide your mobile number to a production using Philamedia's Services, you consent to receive recurring transactional text messages related to that production — including your personal call-sheet link, call times, location and schedule details, and changes/updates.

Message frequency: Recurring; frequency varies based on production activity and the shoots you are booked on.

Cost:Message and data rates may apply.

To opt out: Reply STOP at any time to stop receiving messages. You may receive a final confirmation that you've been unsubscribed.

Carriers and mobile operators are not liable for delayed or undelivered messages. These messages are operational/transactional, not marketing. See our Privacy Policy for how we handle mobile information; mobile opt-in information is never shared with third parties.

6. User content and production data

Productions and users submit content such as schedules, locations, contact details, photos, and notes ("Content"). As between you and Philamedia, you retain ownership of your Content. You grant Philamedia a limited, non-exclusive license to host, process, and display Content solely to operate and provide the Services. You are responsible for ensuring you have the rights and any necessary consents to submit Content, including others' contact information.

7. Intellectual property

The Services, including software, design, and branding, are owned by Philamedia or its licensors and are protected by law. Except for the rights expressly granted here, no rights are transferred to you. You may not copy, modify, distribute, or create derivative works of the Services without our permission.

8. Third-party services

The Services rely on third-party providers (for example, messaging, email, hosting, storage, mapping/weather, and AI processing). We are not responsible for third-party services, and their terms and privacy practices govern your use of them.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that messages or notifications will always be delivered. Call sheet information is provided for convenience; verify critical details independently.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHILAMEDIA AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

11. Indemnification

You agree to indemnify and hold Philamedia harmless from claims, damages, and expenses (including reasonable legal fees) arising from your Content, your use of the Services, or your violation of these Terms or the rights of others.

12. Termination

We may suspend or terminate access to the Services at any time, with or without notice, including for violations of these Terms. Sections that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of Pennsylvania, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Philadelphia County, Pennsylvania for any disputes.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted with a new effective date; continued use after changes means you accept them.
